Cleo Avenue Affordable Housing Development - RFP
The Housing Division is responsible for the administration of the City’s federally funded Community Development Block Grant (CDBG) Program; administration of the Below Market Rate (BMR) Program; oversight of the tenant/landlord conciliation/mediation contract; and promoting the construction of affordable housing units serving extremely-low, very-low, median and moderate income households.
Community Development Block Grant Program
The City of Cupertino awards CDBG funding to several non-profit agencies to provide public services for extremely low, very-low and low-income households. Below is a list of the agencies receiving funding from the City of Cupertino. The city’s Housing Commission and the City Council review these agencies annually for consideration of funding.
Community Development Block Grant (CDBG) Application Process
The City of Cupertino has opened its application process for Community Development Block Grant (CDBG) and Human Service Grant funds for fiscal year 2007/08. The city of Cupertino is receiving approximately $357,871 from the Department of Housing and Urban Development (HUD) in CDBG funds. Of the $357,871, only $53,680 is available for Public Service activities. The CDBG funds will be distributed on a competitive basis to assist housing and housing related projects. All projects must benefit low and very-low-income households within the city of Cupertino limits.

Potential applicants are discouraged from requesting additional funds for projects that have received funding allocations in a prior year and have not expended those funds.
At this time the City of Cupertino does not know whether General Fund monies will be available for the Human Service Grant program, agencies that currently receive Human Service Grant program funding from the City’s General Fund are encouraged to apply for CDBG public service funding. If General Fund money is allocated for Human Service Grants, the agencies applying for CDBG funds will be considered for the distribution of the General Fund money.

Consolidated Plan (13 MB)
The Consolidated Plan is a comprehensive planning document that identifies a jurisdiction's overall needs for affordable housing and nonhousing community development, outlining a strategy to address those needs. The five-year strategy and one year Action Plan proposed are designed to correspond with adopted goals from the City's General Plan Housing Element. The Consolidated Plan includes the City's application for the CDBG grant of $474,000 for fiscal year 2003/04.
Every five years, the federal government requires that the entire document be updated. During the intervening years, only the one-year annual plan must be submitted for approval, along with any substantial changes.
Annual Action Plan
The Annual Action Plan is a one-year plan which describes the eligible programs, projects and activities to be undertaken with funds expected during the program year (Fiscal Year 2005-2006) and their relationship to the priority housing, homeless and community development needs outlined in the Consolidated Plan.
Consolidated Annual Performance Report (CAPER)
The City of Cupertino's 2005 Consolidated Annual Performance Report evaluates and assesses how well the City of Cupertino was able to accomplish the goals established in the 2005 Annual Action Plan as well as the current Consolidated Plan (Con Plan). In addition to the evaluating the city's progress in meeting the Consolidated and Annual Plan goals, the CAPER describes the city's low-income housing and community development activities for Fiscal Year 2004-05 (July 1, 2004 - June 30, 2005) and the funds made available for each of the activities.

Annually, the City of Cupertino provides approximately $40,000 to non-profit agencies providing needed services to Cupertino residents. Below is a list of the agencies receiving funding and contact information.

Affordable Housing
Below Market Rate (BMR) Housing Program
The City of Cupertino required that 15% of all new construction be affordable to households below 120% of the County median income. Rental units are affordable to very low and low-income households while ownership units are affordable to median and moderate-income households.
The City of Cupertino contracts with Cupertino Community Services (CCS) to screen and place qualified households in most of the city's BMR units. CCS maintains a waiting list of interested persons for these BMR units. If interested, call (408) 255-8033 and leave your name, phone number, number of persons in your household and the type of unit (ownership or rental) that you are interested in occupying. You may also download an application at the agency's website.
Aviare Apartments and Forge-Homestead Apartments conduct their own screening and placement of eligible households in BMR units located in these two complexes. Housing Mitigation Manual (335 KB)
The Housing Mitigation Manual establishes procedures to implement housing mitigation as required by the General Plan Housing Element. This manual consists of two major components, Section One addressing the office and industrial mitigation and Section Two addressing residential housing mitigation.
Mortgage Credit Certificate (MCC) Program
The Mortgage Credit Certificate Program provides a tax credit to first-time homebuyers for the purchase of single-family homes, townhomes and condominiums. A first-time homebuyer is defined as a person who has not had their name on a Santa Clara County property title for a principal residence within the last three years.

Teacher Housing Assistance Program
In 2003, the City of Cupertino developed a down payment assistance program to assist qualifying Cupertino teachers in their quest for homeownership. The terms of the loan are similar to the San Jose Teacher Housing Program, which was reviewed by the Cupertino Housing Commission and found to be preferred over other existing teacher programs. The program is easy to administer and easy for the borrower to understand. The following is a list of the loan terms:
- Maximum loan amount of $66,666 for down payment assistance
- Zero percent loan deferred for 30 years or until transfer of property title.
- Home must be borrower’s principle residence for the term of the loan.
- Resale restriction will be recorded against the property. Term of resale restriction shall be 45 years.
Borrower can resell within the period covered by the resale restriction to a qualifying teacher; or
Resell the unit at market value within the period covered by the resale restriction and pay the City of Cupertino an equity share. Equity share percentage to be determined.
- Teachers must be employed in the Cupertino Union School District (CUSD), Fremont Union High School District (FUHSD) or the Foothill-DeAnza College District (FDCD).
- Teacher is defined as a credentialed full-time teacher employed by CUSD, FUHSD and FDCD
- Homes must be purchased within the city of Cupertino limits
Neighborhood Housing Services Silicon Valley (NHSSV) is working with the participating school districts to provide outreach to inform teachers about the program and assist the teachers throughout the purchase process. NHSSV also offers homebuyer education classes, credit repair and budget counseling.
