      - A construction management plan shall be submitted to the City for review and approval prior to building and grading permit issuance.
      - Elements of the existing historical home shall be used to construct a trellis or gazebo structure at the common plaza area.
      - A $25,000 contribution shall be provided by the applicant for enhancement s to the pedestrian walkway along the west side of the N. Stelling Road bridge that crosses over Interstate 280.
      - New detached park strip shall be provided as part of the revised curb plan.
      - Applicant shall submit a green building design program to the City for review and approval prior to building permit issuance.

    Location:

    1. ARCHITECTURAL AND SITE APPROVAL to construct an additional 116 apartment units, a public park, a recreational facility, and leasing office within an existing apartment complex (Villa Serra/The Grove) for a total of 504 units.
    2. VARIANCE from the R3 (apartment) rear yard setback requirements.
    3. PARKING EXCEPTION from 2 spaces per unit to 1.74 spaces per unit.
    4. TREE REMOVAL for the removal of 92 trees and a replanting plan on a proposed modification to an existing apartment development.
    5. ENVIRONMENTAL DETERMINATION: Negative Declaration recommended. The project will have no significant, adverse environmental impacts.

    Status:
  • The Project was approved by the City Council on July 3, 2007. Main discussions points are as follows:
    • Addition of 116 new apartment units, including 70 one-bedroom units and 46 two-bedroom units. The existing complex consists only of one and two bedroom apartment units.
    • Approximately 10,000 square foot Traffic Operations Center (TOC) to be relocated to adjacent area south of the existing location, with the applicant required to fully fund the relocation of the TOC, including relocating the existing shed structure and modular office, extending electrical and fiber optic cabling, and paying up to $50,000 for a new storage facility at the new TOC location to replace the existing storage container.
    • Franco Court width is to be retained at the current width (40 feet, curb-to-curb) and no parking will be permitted on Franco Court.
    • New .7 acre public park to be constructed on the southwest corner of Homestead Road and Franco Court.
    • Public Art will be installed.
    • Bike/pedestrian access only from Villa Serra to Franco Court; no driveway access will be permitted.
    • Retain 18 of the 92 trees proposed to be removed.
    • Provide a landscaped parkway treatment along Homestead and Stelling Roads.
  • Building permits have been submitted and are under review.
  • Site demolition work has commenced.
  • Construction anticipated to begin in the 2nd Quarter of 2008.
  • Park Commission reviewed the preliminary park design on February 7, 2008, April 2, 2008, and June 5, 2008 with the following recommendations:
    1. - Option A (the version without the half basketball court)
      - Use native plants (trees and shrubs) throughout.
      - Use ‘Green’ building/construction materials.
      - Incorporate a public restroom facility.
      - Pathways within the park shall consist of (semi-permeable) interlocking pavers subject to approval from the Director of the Public Works Department and San Jose Water (for pathway surrounding the pump area).
      - Add additional picnic tables in the northwest corner of the park.
      - Minimize the fence enclosure around the pump equipment to the maximum extent possible while meeting San Jose Water’s needs.
      - Delete 10 parking stalls along the west side of the park allowing the park area to expand.
      - Incorporate an entry for pedestrians on the southeast corner of the park.
      - Install plain wrought iron fencing around the perimeter.
  • City Council is scheduled to review the park design on August 5, 2008.
